These Terms of Service ("Terms") govern your use of Product Party, a service operated by Beeps, Inc. ("Beeps," "we," "us," or "our"). By using Product Party, you agree to these Terms.

By accessing or using Product Party, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, you may not use our services.

2. Description of Service

Product Party is a platform that transforms user research into interactive AI-powered personas. Our service helps you validate ideas, gather feedback, and build products with confidence through conversational interfaces with synthetic user personas based on your research data.

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You are responsible for all activities that occur under your account

4. Acceptable Use

You agree not to:

• Use Product Party for any illegal or unauthorized purpose
• Upload content that infringes on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service or servers
• Upload malicious code or viruses
• Use the service to harass, abuse, or harm others
• Violate any applicable laws or regulations

5. Content and Intellectual Property

Your Content

• You retain ownership of content you upload to Product Party
• You grant us a license to use your content to provide and improve our services
• You represent that you have the right to upload and use the content

Our Content

• Product Party and its features are protected by copyright and other laws
• We grant you a limited license to use Product Party for your personal or business purposes
• You may not copy, modify, or distribute our software or content

6. Pricing and Payment

• Current pricing is available at productparty.ai/pricing
• Subscription periods are monthly unless otherwise specified
• We may update pricing with 30 days' notice
• Payments are due within 5 days of invoice
• All fees are non-refundable except as required by law

7. Service Level Agreement

We will use commercially reasonable efforts to provide and maintain Product Party without excessive errors and interruptions. If we fail to meet this standard for two consecutive months, you may terminate your subscription and receive a prorated refund.

8. Privacy and Data Protection

Your use of Product Party is also governed by our Privacy Policy. We are committed to protecting your data and maintaining its confidentiality. AI-generated personas and insights are based solely on the research data you provide.

9. Disclaimers and Limitations of Liability

• Product Party is provided "as is" without warranties of any kind
• We do not guarantee that personas will perfectly represent your actual users
• AI-generated content should be validated with real user research
• Our liability is limited to the amount you paid us in the past 12 months
• We are not liable for indirect, incidental, or consequential damages

10. Termination

• You may cancel your subscription at any time
• We may suspend or terminate your account for violation of these Terms
• Upon termination, your right to use Product Party will cease
• We will delete your data within 30 days of termination unless legally required to retain it

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the service. Continued use after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts in Delaware.
